Article 1 – GENERAL INFORMATION
The simplified joint stock company Maje (hereinafter referred to as the "organising company") with a capital of 100,000 euros, registered with the Trade and Companies Register under number 382 544 310, whose headquarters are located at 24 rue du mail, 75002 Paris, France, represented by Mrs Isabelle Guichot in her capacity as CEO, is organising a prize draw that is free to enter with no purchase necessary, entitled "Maje – Unmissable" on the www.maje.com website, from 15 October 2017 to 31 March 2018 at 11.59pm inclusive.
Article 2 – CONDITIONS OF ENTRY
2.1 Accessing the competition
This competition is open to any private individual of full age, residing in the following European countries: France, Belgium, Great Britain, Ireland, Germany, Spain, Italy, Netherlands, Portugal, Austria, Luxembourg, with the exception of anyone employed by the companies who are directly or indirectly involved in organising or executing the competition, or their families, and is limited to one single entry and one single win per person. The organising company may directly or indirectly carry out any necessary checks in order to check the capacity of entrants.
Multiple entries (same email address) will not therefore be accepted.
The organising company reserves the right to ask any entrant to provide proof of adherence to these conditions. Any person who fails to satisfy these conditions or refuses to prove adherence to them shall be barred from the competition and shall not be entitled to their prize, should they win.
By taking part in the competition, entrants accept these rules unconditionally. In the event of a discrepancy in the way these rules and the business documents or competition description are interpreted, these rules will take precedence.
2.2. How to enter
To enter the competition, entrants must have internet access and a valid email address. Entrants must connect to the maje.com website by filling in the entry form and completing the compulsory field, i.e. their email address, and agree to receive the free Maje newsletter. Any incomplete form will be immediately declared void.
The competition runs from 15 October 2017 to 31 March 2018 at 11.59pm inclusive.
Article 3 – PRIZES
A monthly prize draw will be carried out by the organising company on the 1st of each month for all entries made during the previous month (from the first to the last day of the month) for the period between 15 October 2017 and 31 March 2018, in order to select the monthly winner of the following prize: a €250 voucher to be used exclusively in the e-shop and in one single transaction within three months of the voucher being issued.
For other competition periods and prizes, one or more amendments will be filed with SCP Jean-Michel Adam/Vincent Ada, Bailiffs of the Court, with whom these rules are filed.
One single entrant may not win twice. A new prize draw will take place if an entrant who has already won is drawn.
Winners will be notified by email within seven days of the prize draw, and must, by return of email within 15 days of the organising company sending the email notifying them of their win, accept their win by confirming acceptance of the prize and indicating their postal address.
The organising company cannot be held responsible for any malfunctions in the email sending system.
If the winners do not accept or indicate express confirmation of their prize within a maximum of 15 (fifteen) days of being contacted by the organising company, this silence will be taken as indication that the winners purely and simply relinquish their prize, and no claim can then be made.
Winners cannot ask the organising company to exchange any prize for another item or service of any value, or for cash. If winners do not want or cannot take possession of their prizes, they will not be entitled to any compensation.
In the event of force majeure or any cause outside of its control, the organising company reserves the right to replace prizes with other equivalent prizes of an equivalent value.
The organising company cannot be held responsible for any incident, accident or other inconvenience that might occur during the enjoyment of the allocated prize and/or its use.
The organising company reserves the right to check the identity of winners.
Prizes will be sent by post to the winners within fifteen (15) days.
The organising company cannot be held responsible for any delay or problem in issuing the prize for transport reasons or as a result of any other exceptional circumstances. In the event of prizes not being delivered due to an incorrect address and/or change of address, or as a result of any other exceptional circumstances, no claim can be made.
Article 4 – REIMBURSEMENT OF ENTRY COSTS
Internet connection costs incurred in entering the competition may be reimbursed at the request of entrants.
Internet connection reimbursement requests must be made by the entrant on a separate sheet of paper indicating, in order to enable verification, the entrant's surname, first name and personal postal address, as well as the connection dates and times. This request must be accompanied by:
o bank account details;
o a photocopy of the last itemised bill issued by the telephone or internet provider, in the entrant's name, proving that the entrant is billed per connection and not at a fixed rate.
This request must be sent by post within fifteen (15) calendar days of receipt of the aforementioned supporting bill, the postmark being proof thereof, to the following address: MAJE, Service Clients, 24 rue du Mail, 75 002 PARIS, France.
This reimbursement will be made by bank transfer or post, upon request made by any entrant under the conditions described below, along with the postage costs of the reimbursement request.
Connection costs and the costs of posting this request will be reimbursed within 30 days of receipt of the said request, at the following rates:
a. connection costs are refunded based on the fixed rate fee for an average connection time of three (3) minutes, at the full rate of a France Telecom STN national call. Entrants who do not pay costs according to the volume of their connection (unlimited fixed rate or free subscription) cannot obtain any refund since they will not incur any costs by entering the competition.
b. postage costs for the request will be refunded based on the current second class rate.
c. The costs of photocopying the bill will be refunded at a rate of 0.10 euro cents.
By definition, reimbursements are made only in the case of actual costs incurred by the entrant. As a result, entrants shall not be entitled to a reimbursement and may be prosecuted for fraud if:
o an entrant requests a reimbursement for posting several requests, where these requests were all grouped together in one item of post;
o an entrant requests a connection reimbursement when he or she had access to the internet via a fixed rate subscription;
o an entrant requests a reimbursement for a telephone call without being able to provide proof of their call.
MAJE reserves the right to make all necessary checks, request any proof (including a copy of the telephone or internet provider's bill, etc.) and start legal proceedings if necessary.
Only one reimbursement request per household will be considered. (same name, same postal address).
Any requests with insufficient postage, or supplied with illegible, crossed-out, incomplete or erroneous information, will be considered void and will not be considered.
Article 5 – PROTECTION OF PERSONAL DATA
Entrants' contact details will be used in accordance with the provisions of the French Data Protection Act (the "Loi Informatique et Libertés") of 6th January 1978, or any other act which might replace it.
In accordance with the French Data Protection Act, the Entrant has the right to access, object to the use of and correct any information relating to his or her Personal Data. If the Entrant wishes to exercise this right and obtain disclosure of the information concerning them, he or she can do so by writing to:

Winners give their express permission for MAJE to use their details (name and first letter of surname), unreservedly and without restriction, for advertising or PR purposes, on any medium, with no right to remuneration or any benefit other than the allocation of their prize.
Article 6 - LIMITATION OF LIABILITY
By taking part in the competition, entrants accept unconditionally these rules in their entirety, the rules of conduct currently applicable to the internet, as well as the laws, rules and other texts applicable in France.
By taking part in the competition, entrants recognise and accept the characteristics and limits of the internet, in particular as regards technical performance, response times for consulting, querying or transferring data, the risks of interruption, and more generally the inherent risks of any connection and transmission over the internet, the lack of protection for certain data against possible misuse and the risks of contamination by computer viruses circulating on the internet.
Consequently, MAJE cannot in any circumstances be held liable for (non-exhaustive list follows):
o the content of services consulted on the Site, and in general for any information and/or data posted on the services consulted on the Site;
o the transmission and/or receipt of any data and/or information on the internet;
o any malfunction of the internet preventing the proper conduct/functioning of the Competition;
o the malfunction of any reception equipment or telecommunications lines,
o the loss of paper mail or email, and more generally for the loss of any data;
o routing problems;
o the operation of any software;
o the consequences of any virus, bug, abnormality or technical defect;
o any damage caused to an Entrant's computer;
o any technical, hardware or software defect of any kind, preventing or limiting the opportunity to take part in the competition, or damaging the entrant's computer system.
It is hereby stipulated that MAJE cannot be held liable for any direct or indirect damage resulting from an interruption, a malfunction of any kind, the suspension or termination of the competition for any reason, or any direct or indirect damage resulting, in any way, from a connection to the Site. Entrants must take all appropriate measures to protect their data and/or the software stored on their computer hardware from attacks. Any person connecting to the Site and entering the competition does so entirely at their own responsibility.
In general, MAJE cannot be held liable if the competition has to be deferred, amended or cancelled in the event of force majeure.
MAJE therefore reserves the right to make amendments to the competition either in terms of content or duration, at any time and without warning or obligation to justify its decision, and cannot be held liable for any such action.
Article 7 – AMENDMENT OR CANCELLATION OF THE COMPETITION
MAJE reserves the right to extend, curtail, amend or cancel the competition at any time in the event of force majeure, with no claim to any compensation by the entrants. In this event, an amendment will be filed with SCP Jean-Michel Adam/Vincent Ada, Bailiffs of the Court, at 9 rue de Prony in Paris, and this amendment will also be available for consultation on the Maje website.
Article 8 – FILING AND CONSULTATION OF RULES
These competition rules are filed with SCP VENEZIA-LAVAL-LODIEU-QUILLET, Bailiffs of the Court, at 130 avenue Charles de Gaulle, 92574 NEUILLY-SUR-SEINE CEDEX, France, and can be consulted on the www.maje.com website.
These rules will be sent, free of charge (with current second class postage reimbursed) to any individual who requests them in writing to the following address: MAJE, Service Clients, 24 rue du Mail, 75 002 PARIS, France.
Only one request for rules per household will be considered. (same name, same postal address).
Any requests with insufficient postage, or supplied with illegible, crossed-out, incomplete or erroneous information, will be considered void and will not be processed.
No written or telephone requests concerning the interpretation or application of these rules or concerning the methods and workings of the competition will be answered.
Article 9 – DISPUTES
These rules are exclusively subject to French law.
Any question pertaining to the application and/or interpretation of these rules will be dealt with independently, according to the nature of the request, by the organising company and/or SCP Jean-Michel Adam/Vincent Ada, Bailiffs of the Court, in accordance with applicable French law.
Any dispute relating to the competition must be notified by post within a maximum of fifteen (15) days from the entry closing date, the postmark being proof thereof, to the headquarters of the MAJE company at MAJE, Service Clients, 24 rue du Mail, 75 002 PARIS, France.
In the event of a continuing disagreement regarding competition entry and/or interpretation of the current rules, and failing any amicable agreement, any dispute shall be considered by the competent Court.
